Terms of Service

1. Who we are

Bright Meadow Learning ("we", "us"), ABN 39 973 076 064, is based at 8 Karragata Ct, Tallebudgera QLD 4228, Australia. Contact us at admin@brightmeadowlearning.com.

2. The service and these terms

These terms apply to our website, games, lessons, Meadow School, Meadow Forest, parent tools, Meadow Planner, Miss Marigold and subscriptions (the "Service"). By registering, you agree to these terms. Our Privacy Policy explains how we handle your family's information, and our Refunds & Cancellation policy forms part of these terms.

The Service supports Australian homeschooling maths from Pre-prep to Year 2, for children aged about 3–8, aligned to the Australian Curriculum. It is a learning aid, not a school or a substitute for any home education registration you need. We do not guarantee particular learning outcomes or promise future subjects, year levels or activities.

3. Accounts and eligibility

4. Your free trial

New accounts receive a 14-day free trial from registration, with no card required. There is no automatic charge unless you choose to subscribe. If you do nothing, play pauses at the end of the trial and your profiles and progress remain.

If you subscribe with more than 48 hours left in the trial, the remaining trial carries over and Stripe schedules the first payment for its end. If you subscribe with 48 hours or less left, the paid subscription starts and the first payment is taken immediately, as shown at checkout. You can wait until the trial ends to use the full free period before paying.

5. Monthly subscriptions

We will give at least 30 days' notice by email of an increase to our subscription prices. It will apply no earlier than your next renewal after that notice period. You can cancel before it takes effect.

6. Pausing, cancellation and failed payments

You can pause a child from Child profiles. This stops that child's play and keeps their profile and progress. It does not cancel your subscription. Resuming a child can cause a prorated price increase as described above.

Cancel through Parent Area → Account & billing → Manage billing, which opens the Stripe Customer Portal. Cancellation takes effect on the date shown there, normally the end of the current billing period. You keep access for the period already paid for, subject to these terms. If your subscription is still trialling, cancel before its first payment date to avoid that payment. Contact us if you cannot access billing.

After cancellation takes effect, play pauses and profiles and progress remain. You can resubscribe. Ordinary cancellation does not automatically refund earlier payments or waive charges already incurred. Our Refunds & Cancellation policy and your Australian Consumer Law rights apply.

After a failed charge makes the subscription past due, play continues for seven days from when our system first records that past-due status. It then pauses until payment is resolved. Payment retries do not restart that grace period. A payment failure or pause in play does not cancel the subscription or erase unpaid invoices; manage or cancel it through the portal.

7. Miss Marigold and AI-generated content

Miss Marigold's parent assistant uses AI to answer questions and suggest learning activities and plans. AI can make mistakes, omit relevant facts or give unsuitable suggestions. Check its output before relying on it. You decide what is appropriate for your child and confirm proposed plan changes before they are saved.

Her replies are general information, not professional educational assessment, medical, psychological, legal or financial advice. Do not use them to diagnose a condition or replace advice from a qualified professional. No AI-generated answer guarantees an outcome.

Using these features sends questions and relevant child learning information to OpenAI. Voice replies and optional microphone transcription use ElevenLabs. Read the Privacy Policy for the data involved, retention and how to avoid these features. Children do not need to use the AI assistant to play or learn.

You may use the replies and plans for your family's learning. AI output may be similar to output given to other people, and we do not promise that it is unique or that copyright exists in every output.

8. Acceptable use and intellectual property

Use the Service lawfully for your family's learning. Do not bypass payment or access controls, misuse another person's account, disrupt the Service, introduce malicious code, or send unlawful or abusive material. Do not use Miss Marigold to generate harmful content or submit information you are not authorised to share.

Our artwork, recordings, models, lesson scripts, software and other content belong to us or our licensors. We give you a personal, non-exclusive right to use them through the Service and to use available reports and printables for your family's learning. Except where the law permits, do not copy, scrape, resell or redistribute the Service or its content without permission.

You retain any rights you have in material you provide. You allow us and our service providers to process it as needed to provide the features you use, as described in the Privacy Policy.

9. Availability and account administration

We use reasonable care and skill to provide the Service. Maintenance, faults or events outside our control may interrupt access. Features may change as we maintain and improve the Service. If we end the Service entirely, we will give at least 30 days' notice where practicable and refund prepaid access we do not provide. Your consumer rights also apply to interruptions and other changes.

We may suspend or close an account where reasonably necessary to address a serious or repeated breach of these terms, fraud, a security risk, unlawful use or a legal requirement. Where it is safe and practicable, we will explain the reason and give you a reasonable opportunity to resolve it. Contact us if you think a decision is wrong.

Administrators can suspend accounts, grant complimentary access or delete accounts. These actions are audit-logged. When we suspend an account, we request that Stripe pause collection. Temporary complimentary access pauses collection until its end; paid billing can then resume under your existing subscription unless you cancel. Permanent complimentary access cancels an existing subscription. These actions do not automatically refund earlier payments or remove any refund right you have by law.

10. Australian Consumer Law and liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, your statutory remedies, or any liability that cannot lawfully be excluded or limited.

For a major failure with a service, you can cancel and obtain a refund for the unused portion, or keep the service and seek compensation for its reduced value. For a failure that can be fixed and is not major, you can require us to fix it within a reasonable time. If we do not, you may have the right to cancel and obtain a refund for the unused portion, or recover the reasonable cost of having it fixed elsewhere. You may also be entitled to compensation for reasonably foreseeable loss or damage.

Any statement about availability, AI accuracy or refunds is subject to those rights. Our liability is subject to applicable law.

11. Deleting your account

You can delete your account from Account & billing. Successful deletion cancels the subscription immediately and waives pending upgrade adjustments that have not yet been invoiced. It does not automatically refund payments already made or waive invoices already issued. Your consumer rights remain.

Deletion removes the child profiles you own and their progress and plans. Your parent record is kept with a replacement name and anonymised email, alongside retained billing, audit and AI usage records, as explained in the Privacy Policy. If cancellation cannot be completed, the service reports an error and you need to retry deletion. Contact us if you need help.

12. Changes to these terms

We may update these terms to reflect changes to the Service, law or security needs. We publish the version and date on this page. We will give reasonable advance notice of material changes by email or a prominent notice, unless an urgent legal or security change requires earlier action. Price increases follow the 30-day rule above. We will seek your agreement where required by law. Changes do not remove rights you already have or apply retrospectively to a dispute.

13. Governing law

These terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction. This does not limit rights or access to courts or tribunals available to you under the Australian Consumer Law or other mandatory law.
